Phone: +385 91 605 3947
Email: info@splityachtcharter.com

We are the charter operator for every vessel offered on this site. When you book here, your contract is with us, not with a third party.

2. Prices, and what is included

All prices are shown in euro and include VAT.

The charter fee includes the yacht for the period stated in your contract and a mooring place in the home marina. For catamarans, the mooring is covered for two days only, the first and the last.

The charter fee does not include fuel, tourist and residence taxes, the permit or transit log, or mooring outside the home marina. Once you have taken the yacht over, you also carry the cost of the daily berth in any port or marina, fuel, oil, water and cleaning.

Charter package, payable at the base. Every booking carries an obligatory package covering the permit, 10 GB of WiFi, bed linen (one set per person), towels (three per person), an outboard engine with 5 litres of spare fuel and a gas bottle. The amount depends on the yacht, so we show it before you book and repeat it in your booking confirmation. It is paid at the base, not on this site.

Tourist tax is 1.33 EUR per person per night. It is not included in the price, it is obligatory, and it is paid in cash at the base.

Security deposit, described in section 6, is also paid at the base and is not part of the price.

We do not charge any surcharge for using a particular means of payment (Article 32(5) of the Croatian Payment System Act). You cover the cost of transferring money to our account.

3. How a booking is made

You choose a yacht and a date, and the site shows the main features, the total price and every charge before you pay. Submitting the order carries an obligation to pay: the amount charged at that moment is the first instalment of the charter fee, and we show it before you confirm. We confirm your booking by email, on a durable medium.

A booking becomes binding for both sides when we send that confirmation. Paying into our account also confirms that you have read and accepted the charter contract and these terms, which form part of it.

4. Payment

Card payments on this site are processed by Teya. We do not store your card details.

What you pay here. The payment you make on this site is the first instalment of the charter fee, not a separate booking fee. It counts in full against the total.

The rest of the charter fee is paid by bank transfer to the account named in your booking confirmation, by the dates set out there. Where your confirmation sets no schedule, the default applies: 50% of the charter fee within 30 days of your booking being confirmed, and the remaining 50% at the latest 30 days before embarkation. If you book fewer than 60 days before embarkation, those two dates overlap, so the whole charter fee falls due on the earlier of them, and we state that date in your booking confirmation.

If an instalment is not paid by its due date, we may cancel the booking and charter the yacht to someone else.

What you pay at the base, and not here: the charter package, the security deposit, and the tourist tax in cash.

5. Your charter

Check-in is at 17:00 and check-out at 08:30. The yacht must be back in the marina on the evening before check-out, by 16:00, so that the handover can be completed. The handover itself takes about an hour, and the yacht is returned cleaned and tidied, without crew or luggage.

If you return the yacht late, we charge one daily charter fee for a delay of up to three hours, and three daily charter fees plus any other costs for a delay longer than that. Bad weather does not excuse a late return.

Yachts are chartered bareboat. You confirm that you hold a valid licence for navigation at sea and a radio operator certificate, and you show the originals at the base. If we find that you are not able to operate the yacht safely, we may decline the handover, or assign a skipper and charge for it.

At handover you check the yacht and its equipment against the inventory list. Any objection has to be raised before you set off. A defect that could not have been seen at handover, or one that appears later, does not reduce the charter fee, but tell us at once and we will put it right.

If you do not take the yacht over within 48 hours of the agreed time, we may terminate the contract.

What you agree to while the yacht is yours

  • Sail only in Croatian territorial waters, only in safe weather and good visibility, and not at night.
  • Do not sublet or hand the yacht to anyone else, race it, use it commercially, or fish professionally or at night.
  • Keep the number of people aboard to the crew list.
  • Keep the logbook, check the engine oil daily, and look after the sails.
  • No pets aboard unless we have agreed it beforehand.
  • Tell us without delay about any accident or damage, and notify the authorities as well if the yacht goes missing, cannot sail on, or is seized.

What we owe you

We hand over the yacht clean, dry and seaworthy, with full fuel and water tanks, at the agreed time and place. If we do not, you can ask for the charter fee back for the days you did not have the yacht.

If we cannot make the yacht available within 24 hours of the agreed handover time and cannot offer you another yacht of at least the same standard, you may withdraw from the contract and claim the charter fee for the days you did not have the yacht. That claim is limited to the charter fee.

If damage or a defect arises from normal wear, tell us and we will remove it. If we do so within 24 hours, no reimbursement is due.

6. Security deposit

The security deposit is obligatory for every charter. It is lodged at the starting marina by credit card when you take the yacht over, and the amount is stated in your booking confirmation.

We return it in full if no damage or defect is found when the yacht comes back. If something is damaged or lost, we keep the part that covers repair or replacement. If the damage means the yacht cannot be chartered afterwards, we also keep the amount matching that loss.

7. Insurance, and what it does not cover

The yacht carries hull insurance and third-party liability insurance, on the terms of the insurer.

Damage that is not reported to us or to the insurer straight away is not covered, and you carry it in full. Damage caused on purpose is not covered either, and it is not capped by the security deposit. Engine damage caused by running the engine without enough oil is not covered.

8. No 14-day right of withdrawal

A yacht charter is a leisure service supplied on an agreed date or within an agreed period. For that kind of service, Croatian consumer law gives no right of withdrawal within 14 days (Consumer Protection Act, Article 86(1)(12)).

This is not a term we chose. It is how the law treats date-bound leisure services, and it is the reason the cancellation terms below are the only thing that governs cancellation.

We tell you this before you book, not only here.

9. Cancellation

If you cannot start your charter, you may find another charterer yourself, with our prior agreement.

If you do not, we keep 50% of the contracted price for a cancellation made up to 31 days before the charter begins, and 100% for a cancellation made within 30 days of the start.

These percentages are of the contracted price, not of what you have paid so far. If you have paid less than the amount we keep, the difference still falls due.

If you cancel for a serious personal reason such as the death of a family member or a severe injury, we do not refund the advance, but we offer you the vessel in another available period in the same season.

Cancellation terms are shown before you confirm a booking and they form part of the contract.

10. Complaints

You can send a written complaint by post to Uvala Baluni 8, 21000 Split, Croatia, or by email to info@splityachtcharter.com. We confirm receipt without delay and answer in writing within 15 days of receiving it.

If you want to raise something at check-out, put it in writing there and we sign it.

11. Out-of-court dispute resolution

If we cannot settle a dispute between us, you may bring it before a notified body for alternative dispute resolution under the Croatian Act on Alternative Resolution of Consumer Disputes:

  • Centar za mirenje pri Hrvatskoj gospodarskoj komori, Rooseveltov trg 2, 10000 Zagreb

If you live in another EU country, the European Consumer Centre Croatia (ecc-croatia.hr) handles cross-border cases. This is the route that will apply to most of our guests.

Supervisory authority: Državni inspektorat, Šubićeva 29, Zagreb (dirh.gov.hr).

12. Governing law and jurisdiction

Croatian law applies, without prejudice to the mandatory consumer protection of the country where you live inside the EU.

Any dispute we cannot settle between us goes before the competent court in Split. If you are a consumer resident in another EU country, this does not remove the right your own law gives you to bring proceedings in the courts of your country of residence, or to be sued only there.
